Dosing marks a milestone for first engineered cell therapy approved in the U.S. for a solid tumor cancer, synovial sarcoma
Philadelphia, Pennsylvania and Oxford, United Kingdom--(Newsfile Corp. - December 2, 2024) - Adaptimmune Therapeutics plc (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/ADAP#NASDAQ">ADAP</a>), a company working to redefine the treatment of solid tumor cancers with cell therapy, today announced that the first patient has been treated with TECELRA&#xAE; (afamitresgene autoleucel). TECELRA is the first engineered cell therapy for a solid tumor cancer approved in the U.S., and the first new therapy option in more than a decade for synovial sarcoma, a rare, soft tissue cancer that most commonly impacts young adults. The patient was treated at Moffitt Cancer Center, one of Adaptimmune's Authorized Treatment Centers (ATCs) and a leader in sarcoma research and treatment.

Gen Digital Inc. (formerly known as Symantec Corp.), located in Tempe, Arizona, paid $55.1 million to satisfy a judgment, concluding a decade of False Claims Act litigation. The judgment required the company to pay $16.1 million in damages and $36.8 million in civil penalties, plus post-judgment interest and costs.
"The department will hold accountable contractors that knowingly overcharge the United States to enrich themselves," said Principal Deputy Assistant Attorney General Brian M. Boynton, head of the Justice Department's Civil Division. "The years spent litigating this case and taking it to trial demonstrate the department's steadfast commitment to protecting taxpayer funds."
Following a four-week bench trial in February and March 2022, the trial court found Symantec liable for making knowing false claims to the United States when it mispresented its commercial sales practices during the negotiation and subsequent performance of a General Services Administration (GSA) contract. In particular, the court concluded that Symantec made false statements to GSA during contractual negotiations in 2006 and early-2007 and continued to falsely certify throughout the performance of the contract through Sept. 30, 2012, that its disclosures of its commercial sales practices were current, accurate and complete. The false disclosures induced GSA to accept and then continue to pay higher prices than it would have had it known of Symantec's actual commercial pricing practices.
The court also found that Symantec continuously violated the Price Reduction Clause, a standard term in these types of Multiple Award Schedule contracts that requires the contractor throughout performance of the contract to maintain GSA's price position in relation to an identified customer or category of customer agreed upon in contract negotiations. These violations deprived the United States of discounts to which it was entitled.
"The trial team secured a $55 million judgment that holds accountable a contractor who intentionally tried to overbill the government," said U.S. Attorney Matthew M. Graves for the District of Columbia. "Because these schemes steal taxpayer dollars, the United States Attorney's Office for the District of Columbia will be steadfast in its efforts to bring fraudsters to justice no matter the complexity of the matter, pursuing them through trial, if necessary, to secure a just outcome."
"The United States deserves fair prices and accurate information from GSA contractors," said GSA Deputy Inspector General Robert C. Erickson. "This outcome is the result of hard work and dedication by a cross-functional team from the U.S. Department of Justice, GSA and GSA Office of Inspector General."
Gen Digital's payment ends a lawsuit filed under the qui tam or whistleblower provision of the False Claims Act, which permits private parties to file suit on behalf of the United States for false claims and share in a portion of the government's recovery. The Act permits the United States to intervene and take over responsibility for litigating these cases, as the United States did here. The qui tam case is captioned United States ex rel. Morsell v. Symantec Corp.,&nbsp;Civ. A. No.&nbsp;12-0800 (DDC), and was brought by Lori Morsell, who administered the contract at issue for Symantec. Her share of the recovery has not yet been determined.
This successful litigation was a coordinated effort between the Civil Division's Commercial Litigation Branch, Fraud Section, and the U.S. Attorney's Office for the District of Columbia, with assistance from GSA's Office of General Counsel and Office of Inspector General.
Senior Trial Counsel Daniel Schiffer and Trial Attorney F. Elias Boujaoude of the Justice Department's Civil Division and Civil Chief Brian P. Hudak for the District of Columbia handled the matter.

Gen Digital Pays $55.1M False Claims Act Judgment for Knowing Overcharges to General Services Administration After Government Prevails at Trial

Bank of America analysts shared a positive outlook for stocks in 2025 during Monday&#8217;s conference call on the <a href="https://www.benzinga.com/topic/expert-ideas">economic and market forecast.</a>
According to the bank, the S&amp;P 500 Index—as tracked by the SPDR S&amp;P 500 ETF Trust (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/SPY#NYSE">SPY</a>)—will climb to 6,666 by the end of 2025, marking a 10% increase from current levels. The forecast underscores confidence in productivity gains, resilient corporate earnings, and strategic sector rotation.
<h3 class="wp-block-heading">16 Years Of S&amp;P 500: From 666 To 6,666</h3>
"We are expecting another good year for equities," said Savita Subramanian, head of U.S. equity strategy at Bank of America. "Our forecast is basically a move from 666 in 2009 to 6,666 in 2025." 
This translates to an annualized return of approximately 10%, driven by robust earnings growth and broader participation across sectors.
The equity outlook for 2025 leans heavily on a projected 13% corporate earnings growth. 
"Although we do believe that 2025 will be a year of rotation rather than just buy the index," Subramanian indicated, hinting at a focus on cyclical stocks as investors seek opportunities beyond mega-cap tech.

<h3 class="wp-block-heading">Sector Rotation and Valuation Themes</h3>
Bank of America's analysis points to cyclicals, particularly financials, energy, and consumer sectors, as key outperformers in 2025. 
Subramanian said that &#8220;the average stock is more attractive than the overall index,&#8221; citing the sharp gap between equal-weighted and cap-weighted S&amp;P 500 valuations.
Analysts at Bank of America highlighted opportunities in large-cap value stocks – as broadly tracked by the Vanguard S&amp;P 500 Value ETF (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/VOOV#NYSE">VOOV</a>) – which they view as well-positioned to weather inflation and interest rate uncertainties. 
&#8220;The key risk under Trump 2.0 is the potential for higher inflation and higher long term interest rates. Our favorite cohort of the S&amp;P 500 is large cap value,&#8221; Subramanian said.
Small caps are expected to outperform large-cap counterparts during the first year of Donald Trump&#8216;s second term.
&#8220;We think the narrative on small caps as the biggest potential outperform,&#8221; analyst Jill Carey Hall said.
However, she indicated that if tariffs and immigration policies are enacted as proposed, especially with a front-loaded approach, they could pose a significantly greater risk to small-cap stocks.
&#8220;Recently proposed tariffs on Canada and Mexico could be a 7% hit to Russell earnings,&#8221; the analyst added. 
<h3 class="wp-block-heading">Productivity and Economic Growth</h3>
Economist Aditya Bhave continues to predict a strong U.S. economy, with productivity gains driving GDP growth to around 2% in 2025. 
"Productivity has accelerated," Bhave said. "We're now on a faster trend growth rate since the start of the pandemic than we were in the previous cycle."
While inflation is moderating, Bank of America warned of persistent risks. "We expect a few tenths extra inflation from tariffs and underlying inflation even setting aside policy changes as being a little bit sticky," Bhave stated.
<h3 class="wp-block-heading">Fed Policy And Risks</h3>
The Federal Reserve is expected to cut rates three times in 2025, bringing the terminal rate to 3.75-4%, according to Bank of America. 
However, Bhave cautioned about uncertainties tied to inflation and trade policy, particularly the potential impact of tariffs.
"Tariffs could add a few tenths to inflation, particularly against China, though FX could offset some of the impact," Bhave said.
