Rescheduling is "not a Panacea to all the problems of the industry" and would not make the issue of oversaturation and lack of investor capital go away, Frank Segall, co-chair of cannabis practice at Blank Rome, told the crowd gathered at the <a href="https://www.google.com/url?q=https://www.benzinga.com/events/cannabis-conference/&amp;sa=D&amp;source=docs&amp;ust=1728424361840576&amp;usg=AOvVaw1ND2uKc7pNLpMdV9WsPfvC">Benzinga Cannabis Capital Conference</a> in Chicago on Tuesday. He was part of the panel, &#8220;Consolidation Trends in the Wake of Cannabis Rescheduling: Identifying Winners and Losers.&#8221;
While it would impact positively the balance sheets of many operators by eradicating restrictions of Section 280E of the Internal Revenue Code and attracting some capital, the shift of cannabis to Schedule III would not result in big players like Wells Fargo crossing over to the marijuana industry, Segall said.
"Legalization is what they&#8217;re mandating for them to cross over," he added.
Segall, alongside three other experts, joined the panel moderated by Scott Greiper, founder and president at Viridian Capital Advisors, to discuss broader market consolidation trends following cannabis&#8217;s shift to Schedule III.
Alongside Segall, Pablo Zuanic, managing partner at Zuanic &amp; Associates LLC; Barbara Webb, tax partner at MGO and Laura Bianchi, co-founder of Bianchi &amp; Brandt discussed which types of companies are positioned to thrive and which are not, as well as how investors can identify solid bets in the new regulatory landscape while avoiding pitfalls in a competitive market.

Zuanic &amp; Associates&#8217; Zuanic said that even though two presidential candidates favor <a href="https://www.benzinga.com/markets/cannabis/24/09/40938172/no-turning-back-now-cannabis-rescheduling-gains-momentum-expert-offers-timeline">rescheduling</a> and a <a href="https://www.benzinga.com/markets/cannabis/24/08/40653233/national-cannabis-roundtable-applauds-deas-move-december-hearing-on-rescheduling-set">DEA hearing</a> on the horizon — with signals the policy shift could happen next year — there's a drop in investor interest in the space. That's compared to the past four years.
"I think that we are getting all a bit ahead of ourselves in terms of optimism here," he said.
Zuanic added the reason why consolidation is not taking place is that valuations are depressed in addition to uncertainty around what rescheduling would really bring. He said the main benefit of rescheduling is making 280E go away.

<h1 class="wp-block-heading">Not Paying Taxes Is Not A Good Idea: Here's Why</h1>
That said, MGO&#8217;s Webb highlighted many cannabis companies are not paying their taxes, which could be counterproductive for operators if cannabis rescheduling takes place. "It&#8217;s a temporary survival tactic, but you can&#8217;t do that forever," she said, adding "the IRS eventually catches up."
Consequences could seriously affect business growth in the long run.
"You might be able to get an installment plan once they do catch up with you," Webb explained. "However, once on an installment plan, a cannabis business not only have to regularly, never miss a payment pay, but also stay current on your current year&#8217;s estimated taxes, which is a huge cash commitment."
Webb added companies that are going to be "superstars" post-rescheduling are cash flow positive with 280E.
The tactic of not paying taxes will have serious consequences when it comes to M&amp;A activity in the space, Bianchi &amp; Brandt&#8217;s Bianchi said. "That&#8217;s going to have a drastic effect on M&amp;A in the future because it&#8217;s already been an issue," she said.
<h1 class="wp-block-heading">Which Acquisitions Are and Will Be Hot</h1>
Speaking of acquisition targets, Bianchi said some buyers are looking at distressed assets, mainly businesses that have difficulties operationally and are not avoiding paying taxes.
She also said the trend of huge deals is over. "We&#8217;re dealing with more creative companies coming together and maybe joint ventures," Bianchi added.
Zuanic &amp; Associates&#8217; Zuanic said that &#8220;there's too much overlap" in deals where one multi-state operator is buying another one. Instead, he proposes brands as acquisition targets.
Brands are and will be a key point of M&amp;A activity, especially in the scenario where interstate commerce is legal, he continued.

Benzinga&#8217;s paper trading contest powered by TradeZero is nearing the end of the first of three contests as entrants compete to win over $30,000 in cash and prizes <a href="https://www.tradezeroedge.com/world-championship-of-trading?utm_source=website&amp;utm_medium=editorial&amp;utm_id=trading_competition&amp;utm_content=static" target="_blank" rel="noreferrer noopener">during a monthly contest.</a>
While Contest 1 may be nearly complete, contestants still have a shot at over $25,000 in cash and prizes in two additional contests, with Contest 2 set to kick off on Oct. 15.

The Contests:&nbsp;Powered by&nbsp;TradeZero, the&nbsp;<a href="https://benzingapartners.go2cloud.org/aff_c?offer_id=467&amp;aff_id=1" target="_blank" rel="noreferrer noopener">World Championship of Trading</a>&nbsp;is the ultimate trading competition for investors to prove their keen eye during a three-month time period.
The first of three separate contests kicked off on Monday, Sept. 16. Contestants had until Monday to sign up for the first contest, which runs through Oct. 14.
Each investor will have around one month across three separate contests to generate the highest profits from a starting balance of $100,000 in a simulated trading account.
Contestants in the World Championship of Trading will have access to Benzinga's Live Squawk product.
Investors will also gain exposure to TradeZero's newly patented short-selling tools.

The tenth-place trader has a balance of $217,997.50, meaning the top 10 traders have all gained at least 100% since the contest began.
First Place Held Down: The leaderboard has featured frequent changes among the top 10, but the leader has been fairly consistent. Andrea S. has been in the top 10 for<a href="https://www.benzinga.com/top-stories/24/10/41126924/benzinga-world-championship-of-trading-powered-by-tradezero-contestants-up-90-in-just-2-weeks-join-n"> three weeks straight</a>, with a first-place position in the last two weekly updates. Andrea S. had a balance of $810,808.75 last week, which means she added nearly $200,000 to her contest trading balance over the last trading week.
In an interview with Benzinga, Andrea revealed she is working on her PhD in mathematics and keeping her eyes on the market during the trading contest.
"It's been wild. I didn't expect to end up in first place," Andrea said.
The contestant said she has learned more about finance and trading in recent years and did some internships in the quant trading sector. Andrea said she has applied the things she learned to trading and sought out to see if they would work in a retail trading contest.
"I think I got lucky."
With a goal of winning the contest now, Andrea is now using strategies that are not like her regular trading.
"I'm going to take on much riskier positions."
The trader said they recently bought some call options in the Chinese stock PDD Holdings (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/PDD#NASDAQ">PDD</a>) after seeing the stocks was up thanks to news of a China stimulus.
Andrea has also been looking at semiconductor stocks recently, naming Taiwan Semiconductor Manufacturing, NVIDIA Corporation and Super Micro Computer.

Contest Rules:&nbsp;The contest is open to residents of the United States and Canada who are 21 years of age or older.
Traders will be able to buy simulated equities and options from U.S. markets during the contest periods starting with a balance of $100,000. No fractional shares will be allowed. Traders have to hold a minimum of one stock or option throughout the contest. A minimum of five days of one trade or more must be completed throughout each contest.
Interested investors have been able to&nbsp;<a href="https://benzingapartners.go2cloud.org/aff_c?offer_id=467&amp;aff_id=1" target="_blank" rel="noreferrer noopener">sign up to join</a>&nbsp;the contest since Friday, July 26. Signing up for the first contest will automatically register an entry in the second and third contests. Traders can sign up for the contests after the start dates as long as it is before a cutoff deadline.

Historically, REITs perform well and have exhibited positive performance following peak interest rates.&nbsp;



Realty Income should perform particularly well following this peak rate cycle. Although the company has continued to grow its earnings over the past few years while facing higher rates, share prices have fallen.



O shares are down nearly 22% from their pandemic high of $74. That high corresponded with the first few rate hikes in 2022. As lending costs increased, the value of Realty Income fell. It&rsquo;s a fairly well-worn pattern that investors would do well to follow. Now that we&rsquo;ve reached peak rates, Realty Income is positioned to thrive again.&nbsp;



The firm shows reasonable upside potential while currently paying a dividend yielding 5.4%. <a href="https://stockanalysis.com/stocks/o/">Earnings are continuing to grow</a> meaning the company dividend is safe. Also, it&rsquo;s one of the best monthly dividends overall and offers an increased reinvestment schedule relative to quarterly <a href="https://investorplace.com/stock-types/dividend-stocks/">dividend stocks</a> due to a higher number of payments.&nbsp;



<h2>Ibotta (IBTA)</h2>

In fact, the company has been performing well even in this current high interest atmosphere. 



With Ibotta, customers link their loyalty cards and payment accounts to Ibotta allowing the it to credit their qualifying purchases. Once the company does that, it credits their accounts with a cashback reward.&nbsp;



Notably, the company currently has sufficient cash reserves to cover its interest payments. That position should improve as interest rates fall. Additionally, it serves as an indication that Ibotta is a company capable of strong operations in any rate environment. Also, IBTA <a href="https://finbox.com/NYSE:IBTA/">holds more cash than debt</a> on its balance sheet.



The company was profitable in 2023 and expects nearly 23% top line growth in 2024. It will continue to be profitable overall per analyst predictions. I think investors should pay attention to Ibotta because healthy <a href="https://stockanalysis.com/stocks/ibta/forecast/">earnings expansion is predicted</a> in 2025.&nbsp;&nbsp;



<h2>Entergy (ETR)</h2>

Recently, investors have become aware of the increasing demand put on the electrical grid due to the growth of artificial intelligence (AI) especially in relation to data centers. Did you know that 1% of all <a href="https://www.buildcentral.com/data-center-construction/">electricity demand globally is attributable to data centers</a>?&nbsp;That fact serves as a stark reminder of the opportunity for AI to increase the prices of utilities stocks.



AI hyperscalers are rushing to install as many AI chips as possible at data centers located throughout the U.S. Also, data centers are being built in lower tax areas where the cost of construction is lower. Entergy is positioned to capitalize on the opportunity given its location.



Lower rates should prompt greater capital expenditures from AI hyperscalers who should soon face lower interest fee servicing fees. Consider investing in Entergy for its position relative to the opportunity and its dividend.



<h2>Angel Oak Mortgage (AOMR)</h2>

Generally speaking, dividends in that range are highly speculative and risky. However, Angel Oak Mortgage&rsquo;s dividend does not look to be especially risky overall.



During the first quarter the <a href="https://ir.angeloakreit.com/news/news-details/2024/Angel-Oak-Mortgage-REIT-Inc.-Reports-First-Quarter-2024-Financial-Results/default.aspx">company reported 51 cents of net income</a> under GAAP reporting practices. It was only liable for 11 cents of distributable earnings during the same time frame. And, it paid a dividend of 32 cents during the first quarter of fiscal year 2024.



Angel Oak Mortgage continues to perform reasonably well in a high rate environment while also operating a non-traditional mortgage business. The company takes on higher risk mortgages including non-qualified mortgages and others designed for borrowers with unique financial situations. Therefore, it should improve operationally as lending costs fall and risks are alleviated.



<h2>Grindr (GRND)</h2>

Its stock has appreciated by more than 30% in 2024 and more than 90% over the past 12 months.



Generally speaking, text stocks like Grindr tend to perform well in a falling interest rate environment for reasons that have been discussed many times. Grindr doesn&rsquo;t have a high level of debt, instead operating with <a href="https://finbox.com/NYSE:GRND">moderate levels of debt</a>.&nbsp;Nevertheless, the company could seek to take on additional debt which will be coming cheaper in the following months. Any such would likely be used to coax even higher growth rates out of the company&rsquo;s operations.&nbsp;



Investors should consider Grindr because the company is moving into profitability in 2024 with massive <a href="https://stockanalysis.com/stocks/grnd/forecast/">earnings expansion expected</a> throughout 2026. Although Grindr has experienced strong price appreciation over the past 12 months, it is expected to rise by approximately 30% per the most recent consensus targets.



<h2>Aspen Aerogels (ASPN)</h2>

The company doesn&rsquo;t operate with particularly high levels of debt. A low interest rate environment&nbsp;directly&nbsp;benefits companies that do operate with high levels of debt immediately making them more&nbsp; viable. Aspen Aerogels operates with moderate levels of debt. The company&rsquo;s liquid assets <a href="https://finbox.com/NYSE:ASPN">exceed its short-term obligations</a>. There&rsquo;s likely no reason for the company to seek additional funding at the moment.&nbsp;



The reason I think the company will garner further attention moving forward is that the markets continue to pivot into small cap stocks overall. Investors have grown weary of the dominance of large tech over the markets. Aspen Aerogels is one such small-cap opportunity that is expected to reach <a href="https://stockanalysis.com/stocks/aspn/forecast/">profitability</a> in 2024.



<h2>Forestar Group (FOR)</h2>

Horton (NYSE:<a href="https://investorplace.com/stock-quotes/dhi-stock-quote/">DHI</a>).&nbsp;



Falling interest rates should spur an increase in building activity and sales of the lots owned by Forestar Group. Revenues fell during the most recent three months yet increased over the last nine. The company appears particularly well-positioned given the fact that it increased its residential lot holdings by <a href="https://www.businesswire.com/news/home/20240718111623/en/Forestar-Reports-Fiscal-2024-Third-Quarter-Results/">40% in the most recent quarter</a>.&nbsp;



In the Q3 of fiscal year 2024, net income increased by 29% to $121.8 million over the last nine months. Operating efficiently, FOR is decreasing interest rates that should prompt a spike in building activity and loan origination.&nbsp;



It looks like Forestar Group was able to pick up large tracts of undeveloped residential land at low prices due to the current lull in demand because of high interest rates. That is precisely the power of large companies. They have the resources to buy up massive amounts of assets at such times. Those lots should be increasing in value as interest rates fall and demand rises.&nbsp;&nbsp;
