Emergent BioSolutions Announces $50M Contract Option From BARDA To Procure Doses Of CYFENDUS (Anthrax Vaccine Adsorbed, Adjuvanted)

The United Nations (UN) High Commissioner for Human Rights, Volker Türk issued a call for the international community to abandon punitive drug policies, declaring that the global <a href="https://www.benzinga.com/topic/war-on-drugs">war on drugs has failed.</a>
"The evidence is clear. The so-called War on Drugs has failed, completely and utterly. And prioritizing people over punishment means more lives are saved,&#8221; said Türk while speaking at the ‘Dealing with Drugs II' <a href="https://www.amsterdam.nl/dealingwithdrugs/two/">conference </a>in Warsaw, which brought together leaders and experts from across Europe and the world last Thursday.
The UN commissioner said there is an urgent need for evidence-based, human rights-focused approaches that prioritize health and inclusion over criminalization. "These policies are simply not working—and we are failing some of the most vulnerable groups in our societies."

<h2 class="wp-block-heading">Radical Shift In Approach</h2>
Türk advocated for treating drug use disorders as public health issues rather than crimes.
"We need to start treating the person, not punishing the drug use disorder," he said, according to a <a href="https://news.un.org/en/story/2024/12/1157836">UN</a> press release.
"Historically, people who use drugs are marginalized, criminalized, discriminated against and left behind—very often stripped of their dignity and their rights,&#8221; he said. "We are destined to fail unless we ensure their genuine participation in formulating and implementing drug policy."
Referring to the devastating human toll of punitive drug laws, Türk called for transformative change. "The so-called war on drugs has destroyed countless lives and damaged entire communities," he said, pointing to record levels of drug-related deaths, rising drug use disorders and illegal drug production.

Türk urged governments to adopt the International Guidelines on Human Rights and Drug <a href="https://www.undp.org/publications/international-guidelines-human-rights-and-drug-policy">Policy</a>. He said harm reduction measures such as decriminalization, supervised consumption sites and access to overdose reversal drugs like naloxone, which rapidly reverses the effects of an <a href="https://www.benzinga.com/topic/opioids">opioid overdose</a>.
<h2 class="wp-block-heading">US Fentanyl Problem</h2>
UN News pointed <a href="https://news.un.org/en/story/2024/12/1157836">out </a>that "North America faces an unprecedented fentanyl crisis with synthetic drugs claiming lives at an alarming rate" across the U.S. and parts of Asia and Africa.
Recent <a href="https://www.cdc.gov/nchs/pressroom/nchs_press_releases/2024/20240515.htm#:~:text=The%20new%20data%20show%20overdose,psychostimulants%20(like%20methamphetamine)%20increased.">data</a> from the Centers for Disease Control show overdose deaths involving opioids in the U.S. (primarily <a href="https://www.benzinga.com/topic/fentanyl">fentanyl</a>) decreased from an estimated 84,181 in 2022 to&nbsp;81,083&nbsp;in 2023.&nbsp;
In March 2023, the FDA <a href="https://www.benzinga.com/general/biotech/23/03/31548384/fda-approves-first-otc-naloxone-nasal-spray-for-opioid-overdose">approved </a>Emergent BioSolutions Inc&#8216;s (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/EBS#NYSE">EBS</a>) naloxone nasal spray for over-the-counter (OTC) use – the first naloxone product approved for use without a prescription.

War On Drugs 'Has Failed, Completely And Utterly': UN High Commissioner Urges Evidence-Based Solutions

<li>On June 1, 2020, Emergent announced a $628 million contract with the U.S. government to produce COVID-19 vaccines.</li>
<li>The company started producing vaccine materials for Johnson &amp; Johnson and AstraZeneca at its Baltimore facility in late 2020.&nbsp;</li>

<h2 class="wp-block-heading has-medium-font-size">Overview</h2>
Emergent BioSolutions (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/EBS#NYSE">EBS</a>)&nbsp;secured over $1 billion in government and pharmaceutical contracts during the COVID-19 pandemic. However, in March 2021, workers at its Baltimore facility mistakenly mixed Johnson &amp; Johnson and AstraZeneca vaccine ingredients, contaminating up to 15 million J&amp;J doses and forcing AstraZeneca to discard tens of millions more. This error delayed J&amp;J's vaccine rollout and disrupted global distribution, causing Emergent stock to drop by over 50% by November 2021. Following these events, a group of shareholders sued Emergent, and recently, Emergent agreed to pay a $40 million settlement to all affected investors.
<h3 class="wp-block-heading has-medium-font-size">How It All Started: Manufacturing Failures&nbsp;</h3>
In the wake of the COVID-19 pandemic, Emergent BioSolutions <a href="https://www.globenewswire.com/news-release/2020/06/11/2046894/0/en/Emergent-BioSolutions-Signs-Agreement-to-be-U-S-Manufacturing-Partner-for-AstraZeneca-s-COVID-19-Vaccine-Candidate.html#:~:text=Development%20services%20will,public%20health%20emergencies.">positioned</a> its Bayview facility as a critical vaccine production asset. In March 2020, the company secured over $1 billion in contracts with Johnson &amp; Johnson and AstraZeneca, including a substantial government Operation Warp Speed contract.
On April 30, 2020, CEO Robert Kramer declared during an earnings call that the company had &#8220;proven manufacturing capabilities&#8221; and was prepared to scale up quickly to meet the demands of vaccine production.&nbsp;
In July 2020, following the AstraZeneca agreement, Emergent further bolstered its claims in a press release, with Kramer declaring, &#8220;Emergent is driven by our desire to advance solutions that will make an impact on this pandemic&#8220;.&nbsp;

The company&#8217;s CDMO business unit head, Syed T. Husain, added that &#8220;Emergent stands ready alongside leading innovators to rapidly deploy our CDMO services to help meet the substantial demand for a vaccine.&#8220;
By early 2021, Emergent shares were trading above $90, fueled by high expectations for the company's role in vaccine production.&nbsp;
However, despite positive public messaging, internal audits and inspections in the summer of 2020 uncovered serious issues at Emergent BioSolutions' manufacturing facilities.&nbsp;
Reports highlighted poor staff training, equipment failures, and inadequate quality control measures, revealing long-standing problems within the company&#8217;s operations. One audit found that &#8220;the flow of workers and materials through the plant was not adequately controlled to prevent mix-ups or contamination.&#8221; Another audit discovered that a manager had &#8220;knowingly deviated&#8221; from standard procedures.
After that, in November 2020, AstraZeneca representatives visiting Emergent&#8217;s Bayview facility raised concerns about poor oversight and GMP compliance.&nbsp;
Emergent&#8217;s VP of Manufacturing acknowledged these issues, mentioning trash buildup in hallways and lapses in GMP standards. An external consultant also warned that the facility was &#8220;NON-CGMP compliant&#8221; and at regulatory risk, but production still continued.
<h3 class="wp-block-heading has-medium-font-size">Contamination Crisis at Emergent's Facility</h3>
In March 2021, a major contamination incident at Emergent's Baltimore facility revealed significant oversight failures. Millions of Johnson &amp; Johnson vaccine doses were mixed with AstraZeneca ingredients, an issue initially detected by Johnson &amp; Johnson's lab in the Netherlands, not Emergent. 
The contamination forced the disposal of tens of millions of AstraZeneca doses and delayed the delivery of approximately 100 million Johnson &amp; Johnson doses during a critical phase of the pandemic.&nbsp;
Following this disclosure, Emergent issued a press release, stating that their &#8220;quality control systems worked as designed&#8221; and that discarding a batch of bulk drug substance &#8220;occasionally happens during vaccine manufacturing.&#8221;&nbsp;
However, that same day the Associated Press released FDA documents obtained through FOIA requests, revealing a history of quality control issues at Emergent&#8217;s facilities dating back to 2017.
FDA leaders reported that the company &#8220;hired a lot of individuals not as familiar with vaccine manufacturing that did not have adequate training.&#8221;&nbsp;
Inspectors found several issues at Emergent's facility, including mismanaged waste, peeling paint, and cluttered equipment. They also discovered that some quality checks were removed from vaccines before an FDA visit in February 2021.&nbsp;
Later, it came to light that Emergent had been forced to destroy vaccine materials equivalent to nearly 400 million doses — much more than the previously reported 85 million.
The situation worsened on November 4, 2021, when Emergent announced that the Department of Health and Human Services had cancelled its $628 million contract, requiring the company to reverse $86 million in Q3 2021 revenue and reduce its contract backlog by $180 million.
The impact on investors was clear as Emergent's stock price dropped by over 60%, from more than $120 in early 2021 to below $45 by November 2021.

These disclosures and the sharp drop in stock price led shareholders to file multiple lawsuits against Emergent, accusing the company of misrepresenting its vaccine production capabilities and concealing serious quality issues.
<h3 class="wp-block-heading has-medium-font-size">Resolving The Case</h3>
After three years of legal proceedings, in September 2024, Emergent agreed to pay $40 million to settle the lawsuit from shareholders. If you invested in Emergent, you may be eligible to <a href="https://11thestate.com/cases/emergent-investor-settlement">file for a portion</a> of the settlement to recover your losses.
As of now, Emergent BioSolutions has made significant progress in its recovery, securing a $50 million settlement with Johnson &amp; Johnson and driving a broader transformation under CEO Joe Papa. In Q3 2024, the company saw a 9% revenue increase to $293.8 million and secured vital government contracts, including a $250 million order to produce vaccines for anthrax, botulism, and smallpox. It also sold its Camden facility for $30 million to streamline operations. However, its stock remains far below previous highs, trading at $8 in November 2024 — a 93.6% decline from its $125 peak in 2021, showing that there is still a long road ahead for a recovery.

<h3 class="wp-block-heading">Trump Will Fix It&nbsp;</h3>
In my previous post (<a href="https://www.zerohedge.com/news/2024-11-06/post-trump-victory-trade">The Post-Trump Victory Trade</a>), I highlighted a half dozen stocks in which my subscribers and I had positions that had double digit gains the day after Trump&#8217;s election victory. In response, a commenter wrote, &#8220;Well, I didn&#8217;t like any of those trades, so I will stick to my Gold and Silver.&#8221;.&nbsp;
As it happened, the day after Trump&#8217;s victory, was also the day of the &#8220;<a href="https://www.zerohedge.com/the-market-ear/great-gold-puke">Great Gold Puke</a>&#8220;, as The Market Ear put it:&nbsp;

&#8230;.must come to an end. Gold is puking, putting in the biggest down candle in forever as it breaks below the short term trend channel. The 50 day comes in around $2635, and the bigger trend line around $2600.

Why would gold tumble after Trump&#8217;s victory? Perhaps there&#8217;s a clue in the Trump campaign&#8217;s slogan, &#8220;Trump will fix it&#8221;. One of the things Trump will fix is the elevated geopolitical risk the world has seen over the last few years, starting with the Russia-Ukraine War, and extending to the wars in the Mideast between Israel and Hamas, and Israel and Iran, and tensions between China and Taiwan.&nbsp;
<h3 class="wp-block-heading">Geopolitical Risk Is Already Starting To Ebb</h3>
The geopolitical risk premium is a key factor influencing the price of precious metals like gold and silver, as they are traditionally seen as a haven during times of instability and war. Given that, note what has happened since Trump&#8217;s victory:&nbsp;
<ul>
<li>Hamas <a href="https://x.com/DonaldJTrumpJr/status/1854516506169585796">has called for</a> an end to its war with Israel. </li>
<li>Russian President Vladimir Putin&nbsp;<a href="https://www.zerohedge.com/geopolitical/putin-praises-courageous-trump-hints-ukraine-talks-phone-call-likely">has congratulated Trump</a>&nbsp;on his victory, praised Trump&#8217;s bravery during the first assassination attempt on him, and expressed an openness toward talks aimed at ending the Ukraine war. Peace between the U.S. and Russia would facilitate peace in the Mideast and elsewhere, given Russia&#8217;s ties to Iran, China, and other key countries.&nbsp;</li>
<li>China&#8217;s President Xi <a href="https://x.com/XHNews/status/1854396381982830623">also extended congratulations</a> and an olive branch to Trump.</li>
</ul>
If Trump succeeds in ending the wars in Eastern Europe and the Mideast, and calming tensions across the Taiwan Strait, that would further reduce gold&#8217;s geopolitical risk premium.&nbsp;
<h3 class="wp-block-heading">The Deflationary Potential Of Trump&#8217;s Domestic Policies </h3>
You&#8217;re probably thinking now that even if peace starts to break out, high inflation is baked into the cake because of government spending, and that should boost the price of gold. Consider, though, the deflationary potential of Trump&#8217;s proposed policies, and those of his close allies.&nbsp;&nbsp;
<ul>
<li>Trump&#8217;s tariffs. Critics of tariffs often point out that they are, effectively, a regressive tax on domestic consumers. This is actually true, and like all regressive taxes, they are deflationary. Just as throwing money and low income Americans boosted inflation during COVID, an effective regressive tax on them would cool inflation.&nbsp;</li>
<li>Trump&#8217;s deportations.&nbsp;Deporting millions of illegal aliens&#8211;or deporting a smaller number and prompting millions more to self-deport&#8211;will have a deflationary effect on sectors such as housing, as there will be fewer consumers competing for the same number of homes.&nbsp;</li>
<li>RFK, Jr.&#8217;s campaign against chronic disease. Every case of diabetes and other chronic diseases RFK, Jr. can prevent with changes to American food policy means a reduction of tens of thousands, if not hundreds of thousands of dollars in health care spending. That would cool healthcare inflation.&nbsp;</li>
<li>Elon Musk&#8217;s Department Of Government Efficiency. Elon Musk has spoken about slashing the number of federal employees (something Vivek Ramaswamy pointed out could be done while avoiding Civil Service regulations) and cutting government waste. That would be deflationary too.&nbsp;</li>
</ul>
<h3 class="wp-block-heading">Much Of This Is Likely To Happen&nbsp;</h3>
We all remember how Trump was stymied in his first term, but he is in a much stronger position now. He won a landslide victory, and is now the undisputed leader of the Republican Party. Plus, he has much smarter, and more competent people on his side now, such as Elon Musk. None of this is particularly good for gold and silver prices.&nbsp;

Despite claiming over 100,000 lives annually, the U.S. overdose crisis received minimal attention during the recent presidential campaign, which concluded with Donald Trump&#8217;s <a href="https://www.benzinga.com/markets/cannabis/24/11/41776510/cannabis-industry-leaders-react-to-trump-victory-expect-changes">victory</a>. This oversight comes as overdose deaths continue to rise among Black and Indigenous Americans, revealing a growing racial disparity in the epidemic.
<h3 class="wp-block-heading">Rising Racial Disparities In Overdose Deaths</h3>
According to a Stateline analysis of federal data <a href="https://kentuckylantern.com/2024/11/04/overdose-deaths-are-rising-among-black-and-indigenous-americans/">covered</a> by Tim Henderson, overdose deaths among white Americans have declined, but deaths among people of color have increased. In 2023, Black and Native Americans experienced overdose death rates of 49.5 and 39.8 per 100,000 people, respectively, surpassing white rates. Health experts attribute this to a lack of targeted resources and funding in nonwhite communities.

&#8220;It is our contention that Black harm reduction isn't about drug use, it's about the harms of not being a white person in this country,&#8221; said Tracie Gardner, co-director of the National Black Harm Reduction Network. Communities of color often struggle to access harm reduction services, which are predominantly designed and led by white institutions.
<h3 class="wp-block-heading">Minimal Campaign Attention</h3>
Throughout the campaign, Trump and his opponent, Vice President Kamala Harris, <a href="https://www.benzinga.com/markets/cannabis/24/10/41299527/kamala-harris-defends-immigration-policy-at-latino-town-hall-criticizes-trumps-border-stance">focused largely on border security and drug enforcement</a> rather than harm reduction strategies.&nbsp;
As a recent Fitler Mag <a href="https://filtermag.org/overdose-presidential-election/">article</a> notes, Trump&#8217;s official platform emphasized escalating the drug war, proposing measures like deploying the U.S. Navy to impose a &#8220;full Fentanyl Blockade&#8221; and cracking down on cartels. Harris, while mentioning a commitment to ending the opioid epidemic, highlighted her background in prosecutions and supported increased border security measures.
Public health experts criticize this approach for failing to address the root causes of the crisis. Kassandra Frederique, executive director of the Drug Policy Alliance, noted that efforts have &#8220;ultimately fallen short of the scale and magnitude this crisis demands.&#8221;
<h3 class="wp-block-heading">Rising Demand For Narcan</h3>
Amid this policy void, demand for naloxone—commonly known by the brand name Narcan—is increasing sharply. Over 250 companies, universities and organizations have pledged to provide free doses of the overdose-reversing medication, <a href="https://www.npr.org/sections/shots-health-news/2024/10/08/nx-s1-5145832/250-companies-schools-and-organizations-pledge-to-provide-overdose-antidote-naloxone">according</a> to NPR. Major corporations like Amazon (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/AMZN#NASDAQ">AMZN</a>), United Airlines (NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/UAL#NASDAQ">UAL</a>) and the National Hockey League are participating in this national effort to curb fatalities.
White House officials noted that the wider availability of naloxone has contributed to a recent 10% decline in overall overdose deaths. &#8220;From airlines to classrooms, from offices to sports arenas, we are grateful to have hundreds of voluntary commitments from organizations and businesses across the country,&#8221; stated Dr. Rahul Gupta, the Biden administration&#8217;s drug czar, prior to the election.
However, experts caution that fatalities remain high, especially among marginalized communities.
<h3 class="wp-block-heading">Emergent BioSolutions Sees Stock Surge</h3>
Meanwhile, Emergent BioSolutions Inc. (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/EBS#NYSE">EBS</a>), the manufacturer of Narcan, has seen its stock perform strongly in 2024. With a diverse portfolio addressing public health threats, the company&#8217;s financial recovery and strategic government contracts position it favorably in the market, <a href="https://www.insidermonkey.com/blog/emergent-biosolutions-inc-ebs-a-standout-among-best-performing-cheap-stocks-in-2024-1371074/">noted</a> Insider Monkey. EBS reported significant revenue growth and reduced debt, contributing to a year-to-date share price gain of over 280%.

Overdose Crisis In Shadows Of Elections As Black, Indigenous Americans Deaths Rise

On Thursday, Emergent BioSolutions Inc. (NYSE:<a class="ticker" href="https://www.benzinga.com/stock/EBS#NYSE">EBS</a>) stock is trading higher on mixed third-quarter earnings and a new mpox trial in Africa.
The company reported third-quarter sales of $293.8 million, up 9% year over year, with the management guidance of $265&nbsp;million–$315 million, and missing the&nbsp;<a target="_blank" href="https://www.benzinga.com/calendars/earnings" rel="noreferrer noopener">consensus of $297.5 million</a>.
The company reported an adjusted EPS of $1.37, a turnaround from a loss of $1.09 a year ago,&nbsp;beating <a target="_blank" href="https://www.benzinga.com/pressreleases/24/11/g41786475/emergent-biosolutions-reports-third-quarter-2024-financial-results" rel="noreferrer noopener">the consensus of $0.14</a>.
Revenues from Narcan&nbsp;(naloxone HCl) Nasal Spray decreased 33% to $95.3 million, primarily driven by the discontinuation of prescription Narcan&nbsp;due to the launch of over-the-counter Narcan&nbsp;in the third quarter of 2023 and lower Canadian retail sales, partially offset by higher sales of OTC Narcan.

Guidance: Emergent BioSolutions updated its 2024 revenue guidance from $1.05 billion &#8211; $1.125 billion to $1.065 billion &#8211; $1.125 billion, compared to the consensus of $1.123 billion.
The updated guidance includes commercial product sales of $420&nbsp;million &#8211;&nbsp;$430 million compared to <a target="_blank" href="https://www.benzinga.com/general/biotech/24/08/40226161/vaccine-maker-emergent-biosolutions-expects-deeper-losses-in-2024-stock-sinks" rel="noreferrer noopener">prior guidance of </a>$450 million – $480 million.
MCM Product sales outlook of $510&nbsp;million &#8211; $550 million, compared to $455&nbsp;million – $490 million expected earlier.
Services segment sales are expected to be $105&nbsp;million &#8211; $110 million, lower than the prior range of $120&nbsp;million – $130 million.
The company expects a 2024 net loss of $203 million &#8211; $183 million, compared to the previous loss range of $314 million – $274 million, and an adjusted EBITDA of $180 million &#8211; $200 million compared to previous forecast of $140 million &#8211; $180 million.
Concurrently, Emergent BioSolutions announced that brincidofovir (brand name Tembexa for smallpox treatment) will be included in a trial conducted and sponsored by PANTHER, under the leadership of the Africa Centres for <a target="_blank" href="https://www.benzinga.com/pressreleases/24/11/g41789320/emergent-biosolutions-supports-new-clinical-trial-evaluating-the-safety-and-efficacy-of-brincidofo" rel="noreferrer noopener">Disease Control and Prevention</a>.
The study will evaluate the safety and efficacy of brincidofovir in treating mpox virus. The trial is scheduled to begin in the coming weeks in the Democratic Republic of Congo and neighboring countries.

The Bank of England cut its Bank Rate by 25bps to 4.75% at its recent meeting. Retail sales in the Eurozone rose 0.5% month-over-month in September versus a revised 1.1% gain in August. The HCOB Eurozone construction PMI climbed to 43.0 in October from 42.1 in the previous month.
The S&amp;P Global France construction PMI climbed to 42.2 in October from 37.9 in the prior month, while German construction PMI declined to 40.2 in October from 41.7 in the previous month.

Asian markets closed mixed on Thursday, with Japan's Nikkei 225 falling 0.25%, Hong Kong's Hang Seng Index gaining 2.02%, China's Shanghai Composite Index gaining 2.57% and India's BSE Sensex falling 1.04%.
China&#8217;s trade surplus widened to $95.27 billion in October from $56.13 billion in the year-ago period. Foreign exchange reserves in Singapore increased to SGD 507.6 billion in October from SGD 499.7 billion in the prior month.

I wrote a post on ZeroHedge this morning ("<a href="https://www.zerohedge.com/news/2024-11-06/victory">Trump Victory</a>") which included a number of reactions to Trump's astonishing victory last night. Trump became the first President to win in non-consecutive terms since Grover Cleveland, 127 years ago. Here, I'll confine myself to some market-related comments.

Trump won Wisconsin; all the House races haven't settled yet, but it looks like our Republican sweep bet will cash too.

<li>Super Micro Computer, Inc.&nbsp;(NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/SMCI#NASDAQ">SMCI</a>). That was the contrarian trade mentioned in the same post with Tesla above. Our bet was that most of the bad news was in the rearview. So there was a good chance the stock would bounce after earnings on Tuesday. Unfortunately, they didn't offer any timeline about getting a new auditor and the stock plummeted on Wednesday.</li>
<li>Rivian Automotive, Inc.&nbsp;(NASDAQ:<a class="ticker" href="https://www.benzinga.com/stock/RIVN#NASDAQ">RIVN</a>). This EV maker was in a number of analysts "Harris basket" of stocks. Meanwhile, they had Tesla in their Trump baskets, and it plummeted about 9% after Trump won. We opened a position in this one back in April, buying the $15 strike calls expiring in January for $1.84. Fortunately, we sold half of those calls at $5.55 in July, for a 202% gain. So we are playing with the house's money on this one. And the company reports earnings after the close on Thursday. Maybe they'll have some good news then. </li>
